If you are charged with drunk driving in Michigan it is important to understand the collateral consequencesof a potential OWI conviction. One such collateral consequence of a drunk driving conviction is the impact on your ability to engage in international travel. Many of the Barone Defense Firm clients travel to Canada and elsewhere for business or pleasure, and we always discuss these issues with them as part of our representation.

For example, under Canada’s Immigration and Refugee Protection Act, a person convicted of a crime may be prohibited from entering Canada to visit, work, or immigrate. This prohibition, or “inadmissibility,” is discretionary, with the power to prohibit entry placed into the hands of Citizenship and Immigration Canada. Canada’s criminal code divides crimes into two categories: first, indictable crimes, and second, summary conviction crimes. Indictable crimes are considered more serious. In making the determination of into which category a particular offense falls, the test is whether or not the foreign crime, if committed in Canada, would have been an indictable offense under Canadian law. Under this test an OWI in Michigan is considered to be an indictable crime in Canada.

Of course, being a forward-thinking Nation, one convicted of an indictable offense may still gain entry into Canada so long as they are able to show that they have been “rehabilitated.” In fact, Canada is so forward-thinking that there is not just one but two ways to show this rehabilitation. These include (1) being found to be de facto or “deemed” rehabilitated, and; (2) being “approved” as rehabilitated. One may also apply for a temporary resident permit.

The first and perhaps least restrictive method of showing rehabilitation to the Citizenship and Immigration Canada is to be “deemed rehabilitated,” and under the Act as this simply requires one to remain crime-free for 10 years. Under Canadian law, anyone who can do that has achieved de facto rehabilitation, and will simply be “deemed” rehabilitated by Canadian officials.

Since many people can’t wait 10 years before their next business or pleasure trip to Canada, one convicted may alternatively apply for an “Approval of Rehabilitation.” In the context of OWI this application can be made only after 5 years have elapsed since the completion of the sentence imposed by the court.

After 5 years an individual may complete and mail in an Application for Approval of Rehabilitation, which requires personal information, information about the conviction, reasons why the person should be considered rehabilitated and supporting documentation. Additionally, there will be a $200.00 or $1000.00 filing fee based on the severity of the underlying conviction. The review process takes six months to a year. At the end of the review, if the application is granted, then the individual may travel into Canada without issue. So, if your client can’t wait 10 years, he or she may be able to gain entry by proving rehabilitation after 5 years.

For those individuals traveling regularly to Canada for business or pleasure, there is one final way to attempt to gain entry without either the 5 or 10 year waiting period and that is through a Temporary Resident Permit. An individual may apply for this permit immediately after the conviction. However, to gain entry on this basis, an inadmissible person must demonstrate that there are compelling grounds, humanitarian and compassionate reasons or national interest grounds for such entry, and must also show that their need to travel outweighs the safety risks to Canadian society. The form and required supporting documentation is exactly the same as the Application for Approval of Rehabilitation, as is the filing fee. However, the scrutiny of the requests for Temporary Resident Permits is much higher if applied for prior to the 5 year waiting period. The normal review period for both the Application for Approval of Rehabilitation and for a Temporary Resident Permit is six months but can take up to one year.

Knowing all this the first thought may be to attempt to plead down the OWI to some “lesser” charge. However, this strategy has its own pitfalls because conviction for OWI may not be a firm prerequisite to inadmissibility. In some instances, Canadian Border Officers may deem an individual inadmissible even if the charges against them were withdrawn or dismissed. In those cases, the individual must provide the officer with complete details of charges, convictions, court dispositions, pardons, photocopies of all applicable sections of foreign law(s), and court proceedings to allow the officer to determine whether or not you are inadmissible to Canada.

Can I end my lease early? And do I have to give notice of termination?

It depends on what type of tenant you are.

If the original lease you signed has not expired, check the date. It is probably for a term of one year and you have a commitment towards that lease. Talk to your landlord and if they will agree to early termination of the lease, get it in writing, including the date you will be leaving and make sure the landlord and you both sign the document. If your landlord will not agree to any early termination of your lease, call your lawyer or your Community Legal Clinic. The tenant is obliged to give the landlord 60 days minimum written notice of their intentions to leave.

A very common way of getting out of such a lease is to find a tenant who is willing to take over your lease, such as by advertising it yourself. See Part VI of the Residential Tenancies Act, about Assignment and Subletting. Check here if the landlord refuses or doesn't respond to an assignment, or contact the IEU.

Assignment of your lease is preferred because the new tenant takes over all responsibility for the lease on the apartment. Subletting is another alternative but because you continue to be liable for the conditions of the lease and so this is usually only used when you want to retain your lease, but will be away for a period of time and want someone else to be living there and (hopefully) paying the rent.

If you never had a lease, or if your original lease expired and you have continued to live in the apartment without signing another one, and you pay your rent on a monthly basis, you have a month-to-month tenancy. You must still give at lease 60 days written notice before the end of the last month you intend to live there. See Period of notice, monthly tenancy.

If you give your notice late, you will be responsible for an extra month.

There are two exceptions to this 60 day rule for monthly tenancies, and those are for terminations which are to be effective on either the last day of February or March. For terminations of a tenancy for the last day of February, the notice must be given no later than the preceding January 1. For a termination effective March 31, the notice must be given no later than Feb. 1. For more information see Period of notice, February notices

Tenants who rent on a week-to-week basis need only give 28 days notice.

2 pkg. Baking yeast

1/4 c. Warm water

1 Tsp. Molasses

2 c. Soymilk

1/2 c. Molasses

4 Tbs. Dairy-free margarine, melted

3 c. Unbleached flour

3 c. Whole wheat flour

Directions
Add yeast and 1 Tsp. molasses to warm water; stir and let sit until bubbly. To a large bowl add soymilk, 1/2 cup molasses, melted margarine and salt. Stir in yeast mixture. Next add flour, one cup at a time. (Mix white and whole wheat flour together before adding). Stir well with each addition. Turn out dough on flat surface and knead about 5 minutes or so until smooth and elastic, adding more flour, as necessary. Place dough into a greased container and cover. Let rise about one hour, in a warm location. Form into buns and let rise about 30 or 40 minutes on greased cookie sheets. Cover with plastic wrap that has been sprayed with non-stick spray. Bake in 350-degree oven about 20 minutes. Cool on wire racks. Note: Or form into two large loaves and bake 30 to 35 minutes. While bread is hot, brush tops with melted margarine or spray tops with PAM, if desired. Recipe by Shirley Wilkes-Johnson

Cheese & Sweetcorn Flan

Ingredients

Pastry

200g 85% wholewheat flour
100g margarine
pinch salt
few drops lemon juice

Filling

250g hard cheese
1tbs flour
1 small tin sweetcorn
2 free range eggs
150ml single cream or milk

Method
1. Make pastry by sifting flour and salt together, rub in margarine, add lemon and enough water to form a dough.
Leave to rest in a cool place for an hour or so.

2. Lightly grease a deep flan dish and line with rolled out pastry.
Grate the cheese and toss with the flour.
Place half in the flan.
Drain the sweetcorn and arrange in the dish.
Cover with the remaining cheese.
Beat the cream and eggs, pour the mixture over the cheese and sprinkle with nutmeg.

3. Bake at 375°F/190°C/Gas Mark 5 for 40 mins.

Arugula Salad

Arugula isn't to everyone's taste, as it has a slightly spicy, peppery flavor. For those who can't get enough of it, this salad with toasted pine nuts will hit the spot.
Yield 4 servings
Time 10 minutes
Tools

* kitchen towel
* bowl
* wooden spoon
* four salad plates

Ingredients

* 2 bunches arugula
* 5-6 T vinaigrette (or just 2 T balsamic vinegar + 4 T olive oil)
* salt
* pepper
* ¼ c parmesan cheese, thinly sliced or coarsely grated
* ¼ c toasted* pine nuts

Directions Wash and thoroughly dry arugula, then place in bowl. Toss with vinaigrette, salt, and pepper, and transfer to salad plates.

Top with cheese and nuts.
Notes *Toss the pine nuts with a tiny amount of oil and toast in a frying pan over medium-high heat, stirring constantly, until golden brown. If the pan starts to smoke, turn down the heat.
